Regulation Monopoly and abuse of dominant position in the digital economy: Comparative analysis of the Chinese and Congolese competition laws

The rapid transformation of digital platforms has created huge digital economies around the world, displacing old business models and straining the competition laws of many countries, which have had to adapt to new realities. China and the Democratic Republic of the Congo (DRC) are both effective as developing countries, but they are clearly at different stages of development. While China has developed a thriving digital economy over the past three decades, the DRC is still in the early stages of developing its own. Consequently, China's competition laws have been tested and evolved to meet the challenges of the digital economy, resulting in landmark rulings against giant digital platforms such as Alibaba and Meituan for abusing their market dominance. This paper compares the regulation of monopoly and abuse of dominant position, the size and nature of the digital economies of the DRC and China, the evolution of competition laws in the two countries, and the application of competition laws in both jurisdictions in order to identify lessons that the DRC can learn to reform and adapt Congolese competition law to ensure competition in the digital economy.
